§3620 Congressional notification of intelligence collection adjustments

Summary

The Director of the National Security Agency must, within 30 days of finding a covered adjustment, send a summary to the congressional intelligence committees (as defined in section 3003) and to the Senate and House Appropriations Committees explaining the change and why it happened. "Covered adjustment" means an NSA action or failure that causes a major change in how much intelligence is collected about a foreign country, foreign organization, or their senior leaders, or that changes the NSA’s rules for sharing intelligence with foreign countries or groups the United States is part of.

(a)Not later than 30 days after the date on which the Director of the National Security Agency determines that a covered intelligence collection or sharing adjustment has occurred, the Director shall submit to the congressional intelligence committees, the Committee on Appropriations of the Senate, and the Committee on Appropriations of the House of Representatives a summary of such adjustment and the cause of such adjustment.
(b)In this section:
(1)The term “congressional intelligence committees” has the meaning given that term in section 3003 of this title.
(2)The term “covered intelligence collection or sharing adjustment” means an action or inaction by the National Security Agency that results in a significant change to—
(A)the quantity of intelligence collected by the National Security Agency with respect to a foreign country, foreign organization, or senior leader of a foreign country or foreign organization; or
(B)policies or practices of the National Security Agency with respect to the sharing of intelligence with a foreign country, organization of foreign countries, or organization of countries of which the United States is a member.
