The Secretary of Defense must get the permits needed for each phase of a construction project in a state of the former Soviet Union before committing more than 40 percent of that phase’s total cost. For a new construction project, no more than 40 percent of the project’s total cost may be committed from Cooperative Threat Reduction funds in any fiscal year until the Secretary (1) determines what permits will be required for the project’s lifetime at the chosen location(s) and (2) obtains from the host state any permits needed to start construction. The Secretary can exceed the 40 percent limit if it is necessary for the national interest, but must notify the congressional defense committees first and explain why. New construction project: a project with no funds committed or spent as of November 24, 2003. Permit: any local or national approval needed for major construction, such as development, building, environmental, or land-use permits.
