§3994 Mining claims

Title 50 › Chapter CHAPTER 50— - SERVICEMEMBERS CIVIL RELIEF › Subchapter SUBCHAPTER V— - TAXES AND PUBLIC LANDS › § 3994

Last updated Apr 6, 2026|Official source

Summary

Protects a servicemember’s mining claim that was properly located and recorded. It pauses the rule that a claim located after May 10, 1872, and not yet patented, must have at least $100 of work or improvements done each year. The pause lasts while the person is on military duty and for 180 days after, and also during any hospitalization or rehab for injuries from duty. During those times the claim cannot be lost for failing to do the yearly work. To get the protection, the claim holder must file a notice where the claim is recorded either before the assessment year ends when military service started or within 60 days after that assessment year ends, saying they are on military service and want to keep the claim.
