If a person is entitled to the protections here because of military service, any health insurance they had the day before they went on duty that ended while they were serving must be put back in place when they leave the military. The restored coverage cannot add a waiting time or exclude a health problem that began before or during the service if that problem would not have been excluded when they had coverage, and if the Department of Veterans Affairs has not found the condition to be a disability caused or worsened by service (see section 105 of title 38). The person must request reinstatement within 120 days after leaving the military. This rule does not apply to people who can join employer-offered benefits under chapter 43 of title 38. For the rest of the original coverage period, premiums cannot be raised above what they were before service, except for general premium increases that affected similarly covered people while the coverage was stopped.
