Allows a federal commission to take and decide claims from U.S. military members who were held as prisoners of war and whose captors broke rules about food, forced labor, or treated them inhumanely. A "prisoner of war" means certain regularly appointed, enrolled, enlisted, or inducted U.S. service members held after December 7, 1941; for the Korean-era group it means those held after June 25, 1950 and before August 21, 1954 (and certain U.S.S. Pueblo crew held January 23–December 23, 1968); and for the Vietnam group it means those held during the Vietnam conflict (starting February 28, 1961). People who voluntarily aided the enemy are excluded. Payments depend on the claim type and time period. For food violations under the Geneva Convention of July 27, 1929, the rate is $1 per day. For labor violations or "inhumane treatment" under that 1929 convention the rate is $1.50 per day. For food violations under the Geneva Convention of August 12, 1949 (Vietnam cases) the rate is $2 per day. The Commission certifies allowed claims for payment from the War Claims Fund or other appropriated funds. If a claimant died, payments go to survivors in this order: spouse (if no children), spouse and children split half/half, children equally (if no spouse), then parents equally (if no spouse or children). Korean-era and Pueblo claims must be filed within one year from the latest of certain dates (including August 21, 1954 or return/death determinations; Pueblo has a June 24, 1970 rule). Vietnam claims must be filed within three years from the latest of certain dates (including June 24, 1970 or return/death determinations). If a person is legally unable to manage money, payments may be handled under the applicable rules for legally disabled persons.
