Title 50 › Chapter CHAPTER 52— - RESTITUTION FOR WORLD WAR II INTERNMENT OF JAPANESE-AMERICANS AND ALEUTS › Subchapter SUBCHAPTER II— - ALEUTIAN AND PRIBILOF ISLANDS RESTITUTION › § 4237
Provide money to the Aleut people instead of giving them Attu Island land, while keeping Attu as protected wilderness. The Secretary must, within 90 days after August 10, 1988, figure out how many acres on Attu were used by Aleut villagers at the start of World War II. The Secretary must include at least 35,000 acres in eastern Attu and may add more using the best available information, including material from Aleut representatives. The Secretary must tell the Corporation the acreage found. Within 120 days after August 10, 1988, the Secretary must set a dollar value for that acreage. The per‑acre value cannot be less than $350 or more than $500, and the total value cannot be more than $15,000,000. The Secretary will consider market value, public and environmental value, and similar land valuations. The Corporation has 30 days to appeal the value, and the Secretary must review and give a final decision within 30 days of the appeal. The Secretary must pay the Corporation the full value found, minus the value of any small parcel conveyed. The Secretary may give the Corporation the old village site (about 10 acres) and land within 660 feet of it. Up to $15,000,000 is authorized for these payments, subject to available appropriations.
