When unenhanced Landsat data are sold cheaper for noncommercial use than for other uses, the Secretary must work with the private companies that sell the data to create a system that stops people from using the cheaper data for commercial purposes. The Secretary can punish anyone who takes data for noncommercial use and then uses it for business. Punishments can include fines up to $10,000 per day per violation, banning the person from buying more unenhanced data, and other steps needed to prevent unfair competition. The Secretary must write rules for how penalties work, let harmed parties file formal complaints, investigate complaints quickly, and report violations to Congress every year.
