The Presidential designee may set up one or more pilot programs to try out new voting technology for absent uniformed services voters and overseas voters under the Uniformed and Overseas Citizens Absentee Voting Act. The designee decides how the pilots are run, but the pilots must not conflict with or replace existing laws, rules, or procedures for military and overseas voters. The pilots may look at things like sending voting materials over military networks, VPNs and cryptographic systems, secure transmission of ballot images, keeping and comparing electronic and paper ballot records, using voting stations on military bases, document upload systems, and how the pilot would work in real conditions and with State procedures. The designee must report progress and results to Congress and include recommendations for more pilots and for any needed laws or administrative actions. Defined terms (one line each): absent uniformed services voter — as defined in section 107(1) of the Uniformed and Overseas Citizens Absentee Voting Act (52 U.S.C. 20310(1)); overseas voter — as defined in section 107(5) of that Act (52 U.S.C. 20310(5)); Presidential designee — the person named under section 101(a) of that Act (52 U.S.C. 20301(a)). The Election Assistance Commission and NIST must give best practices or standards to support the pilots. If the Election Assistance Commission has not issued required electronic absentee voting guidelines, it must report to the relevant committees of Congress not later than 180 days after October 28, 2009, explaining why, giving a timeline for the guidelines, and listing its actions since October 28, 2004. Relevant committees are: Senate Appropriations, Armed Services, and Rules and Administration; House Appropriations, Armed Services, and House Administration. Money may be appropriated as needed to carry out these programs.
