Summary

Creates an Executive Director for the Commission who is paid no more than the rate for level V of the Executive Schedule under section 5316 of title 5. The Executive Director serves a 4-year term and can stay longer only if the Commission votes to reappoint them. If the job is vacant, the Standards Board and the Board of Advisors each must form a search committee and suggest at least three candidates. The Commission will consider those candidates. While the job is open, the Commission’s General Counsel acts as the Executive Director until a new one is named. The Standards Board and Board of Advisors must form their search committees soon after their members are appointed. The Commission may name an interim Executive Director before those recommendations, but that interim term may not exceed 6 months. The Commission also must appoint a General Counsel who works under the Executive Director for a 4-year term, subject to reappointment by the Commission. The Executive Director can hire staff and set pay under Commission rules. The Executive Director, General Counsel, and staff may be hired outside normal federal competitive hiring and pay rules, but no one can be paid above the level V limit. The Executive Director can buy temporary services under section 3109(b) of title 5 with Commission approval. Federal agencies may lend staff to the Commission for payback, and the Commission can provide or arrange staff help for the Boards. The Executive Director and staff must consult the Boards when making program goals and plans.
