The Secretary of the Interior can plan, buy, build, expand, improve, run, and protect airports in the continental United States that are on or near System units, when those airports are needed for the Interior Department to do its work. Key words used in the law—"airport," "project," "project costs," "public agency," and "sponsor"—are defined in 49 U.S.C. 47102. Before the Secretary may buy, create, or build an airport, that airport must be listed in the national plan of integrated airport systems made under 49 U.S.C. 47103. The airports must be run and kept up following rules from the Secretary of Transportation. The Secretary may get land and rights, hire contractors, make agreements with other public agencies, and take other needed actions, but may not acquire land without the state governor’s and the local chief executive’s consent. The Secretary can sponsor projects under subchapter I of chapter 471 of title 49 and use contributed or specially authorized funds to pay the sponsor’s share. Unless another law says otherwise, these airports must be open for public use on fair terms and without unfair discrimination.
