Creates an Executive Director for the Council. The Chairman picks the Director with the Council’s agreement. The Director reports to the Chairman and does the jobs the Chairman assigns. The Director appoints a General Counsel who advises the Council and reports to the Director. The Director also hires other lawyers to help the General Counsel, represent the Council in court (including enforcing agreements), help the Justice Department with Council cases, and do other legal work the Council needs. The Director may hire staff paid under the competitive service up to the highest rate for grade 15 of the General Schedule (see section 5332 of title 5). With the Chairman’s approval, up to 5 employees may be hired at pay rates above that or in the Senior Executive Service (see section 3393 of title 5). The Director may also hire extra workers outside regular civil service rules and hire experts or consultants under section 3109 of title 5. Financial and administrative services (like budgeting, payroll, and buying) must be provided by the Secretary or another agency or private party by agreement, paid by the Council in advance or by reimbursement as agreed. If a federal agency provides those services, its rules for collecting erroneous payments (section 5514(b) of title 5) and for administrative control of funds (sections 1513(d) and 1514 of title 31) apply. Other agencies may give the Council funds, staff, facilities, or services if requested and available, and such funds must be obligated by the end of the fiscal year after they are received. The Council may buy or accept property, facilities, services, and donations; the Director may manage them. Employees moved to the Council under section 207 of the National Historic Preservation Act keep their competitive-service rights. The Council is exempt from chapter 10 of title 5 and is governed by subchapter II of chapter 5 and chapter 7 of title 5.
