Title 54 › Subtitle Subtitle III— - National Preservation Programs › Chapter CHAPTER 3061— - PROGRAM RESPONSIBILITIES AND AUTHORITIES › Subchapter SUBCHAPTER II— - LEASE, EXCHANGE, OR MANAGEMENT OF HISTORIC PROPERTY › § 306121
After talking with the Council, each federal agency must, when practical, find alternative uses (including adaptive use) for historic property it doesn't need. An agency may lease that property or trade it for similar historic property if the agency head decides the deal will protect the property. Money from such leases can be kept by the agency to pay administration, maintenance, repair, and related costs for that property or other National Register property it owns or controls. Any surplus must be deposited in the Treasury at the end of the second fiscal year after the money is received.
