The Department must make its yearly Federal response plan follow section 319 of the Public Health Service Act (42 U.S.C. 247d). Agencies must share information fully. If the HHS Secretary declares a public health emergency under section 319(a) (42 U.S.C. 247d(a)), the Secretary must keep agencies like the Department of Homeland Security, the Department of Justice, and the FBI fully and currently informed. If there is a possible public health emergency but no declaration, those agencies must keep the HHS Secretary and the CDC Director fully and currently informed.
