Title 6 › Chapter CHAPTER 1— - HOMELAND SECURITY ORGANIZATION › Subchapter SUBCHAPTER VIII— - COORDINATION WITH NON-FEDERAL ENTITIES; INSPECTOR GENERAL; UNITED STATES SECRET SERVICE; COAST GUARD; GENERAL PROVISIONS › Part Part J— - Secure Handling of Ammonium Nitrate › § 488e
People cannot buy ammonium nitrate unless they are registered under the law’s registration rules (subsection (c) or (d)). The buyer’s agent must also be registered. Facility owners cannot give ammonium nitrate to anyone who is not registered. You also must have the required registration number to buy, and facility owners must have a registration number to run a facility. Everyone must follow the other rules in this part. Breaking these rules can lead to a civil fine of up to $50,000 for each violation. Before setting a fine, the Secretary will look at what happened, any past violations, the person’s ability to pay, and the likely business impact. No fine can be imposed until the person gets notice and a chance for a hearing in their county, parish, or city of residence. The bans on buying and transfers start 6 months after the Secretary issues a final implementing rule.
