The Commissioner may deny some or all C‑TPAT benefits if a participant’s security practices do not meet the rules. The Commissioner must have protections in place before taking away benefits, but those protections cannot stop actions needed to protect national security. If a participant knowingly gives false or misleading information during validation, the Commissioner must suspend or expel them and may publish their names in the Federal Register after appeals. Appeals go to the Secretary: file within 90 days for denials and within 30 days for suspensions/expulsions; the Secretary must decide within 180 days.
