States may control the sale or use of a federally registered pesticide inside the State, but they cannot allow any sale or use that federal law forbids. A State may not add or keep extra labeling or packaging rules beyond what federal law requires. A State can register extra, local uses of a federally registered pesticide if the federal government has not already denied or canceled that use. That state registration is treated like a federal registration for legal purposes, but it only allows use inside that State. The Administrator can reject a State registration within 90 days, and must tell the State and give time to reply before doing so, except when the use would violate the Federal Food, Drug, and Cosmetic Act or would create an imminent hazard — then the Administrator can act right away. The Administrator may also suspend a State’s power to register pesticides if the State cannot or will not exercise proper controls, after giving notice and a chance to respond.
