When the government ends up with extra farm commodities bought under price support programs that it will not sell or use, those foods must be given free to certain nutrition programs. That includes meal programs under the Older Americans Act, child nutrition programs that serve food, and food banks in the special nutrition projects under section 4004. The food can be sent in bulk to group meal sites and to home-delivered meal providers. The Commodity Credit Corporation can spend available funds to run this program and to further process foods to make them easier to use. Examples of included commodities are dairy products, wheat and wheat products, rice, honey, and cornmeal. For fiscal years 2008 through 2023, when free commodities go to any USDA nutrition program, the Secretary of Agriculture must promote deals with private companies to reprocess those commodities into finished food products for eligible agencies, with the agencies paying the reprocessing costs. Private companies must annually settle accounts with the Secretary and relevant State agencies to stay eligible. When commodities go to agencies under section 311(a)(4) of the Older Americans Act, the Secretary must encourage access to processed products if it is cost effective, using efficient methods such as direct purchase, State contracts, State processing, or private-company agreements as part of the national commodity processing program (starting in fiscal year 1994). In fiscal years 1992, 1993, and 1994, the Secretary must run a pilot in up to three States to test making certain commodities available as reprocessed end products under these agreements, with agencies paying the reprocessing and the Secretary considering agency needs and processor availability.
