Require dairy manufacturers and anyone storing dairy products to report market data so people can make better, fairer decisions. Reports must include price, quantity, and moisture content of products sold, and the amount stored. The reports are limited to the package sizes, the exact data, and the reporting frequency that are actually used to set minimum prices for Class III or Class IV milk under federal milk marketing orders. The format in use the day before November 22, 2000 must be improved so market participants can understand it. The Secretary may exempt any manufacturer that processes and markets less than 1,000,000 pounds per year. The Secretary must set up an electronic system, protect reporters’ identities and business secrets (and the data won’t be released under the federal Freedom of Information Act), check reported data for accuracy, and run quarterly audits. A weekly public report must be published by 3:00 p.m. Eastern Time each Wednesday for the previous week. No fees may be charged for reporting or accessing reports. Reporters must keep original contracts and records for 2 years and provide them on request. Willful failure to report is unlawful; the Secretary can order compliance, the order can be appealed in court within 30 days, and failure to obey a final order can lead to court enforcement and up to $10,000 in fines per offense.
