The Secretary must quickly create rules and guidelines to carry out this subchapter. The Secretary must consult with the Attorney General while doing that. Each year the Secretary must send a report with updates on implementation to the House Committee on Agriculture and the Senate Committee on Agriculture, Nutrition, and Forestry. The Secretary has the sole authority to make federal rules about producing hemp, including rules to implement sections 1639p and 1639q, subject to subsection (c)(3)(B). Nothing here changes the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 301 et seq.), section 262 of title 42, or the authority of the FDA Commissioner or the Secretary of Health and Human Services under those laws, including their power to make rules about hemp production under those laws.
