The Secretary must buy and send food commodities to States for emergency food assistance. The law sets exact dollar targets and how to adjust them each year. The rule uses $190,000,000 for fiscal year 2008 and $250,000,000 for fiscal year 2009. For each fiscal year 2010 through 2023, the Secretary must buy the $250,000,000 amount adjusted by the percentage change in the Thrifty Food Plan between June 30, 2008 and the June 30 before the fiscal year. For fiscal years 2015 through 2023, the Secretary must add extra amounts to that adjusted figure: 2015 = $50,000,000; 2016 = $40,000,000; 2017 = $20,000,000; 2018 = $15,000,000; 2019 = $23,000,000; 2020 = $35,000,000; 2021 = $35,000,000; 2022 = $35,000,000; 2023 = $35,000,000. For fiscal year 2024 and later, the Secretary must use the 2023 added amount ($35,000,000) adjusted by the percentage change in the Thrifty Food Plan from June 30, 2023 to the June 30 before the fiscal year. Funds are available for two fiscal years, and States may carry over unspent balances under rules the Secretary sets. When buying commodities, the Secretary should, when practical, consider farm market conditions, States’ and distributing agencies’ needs, and what recipients prefer.
