The Secretary of Agriculture can pay Department of Agriculture workers who work at plants covered by the Federal Meat Inspection Act (21 U.S.C. 601 et seq.) or the Poultry Products Inspection Act (21 U.S.C. 451 et seq.) for overtime and holiday work. The Secretary sets the pay rates, but those rates must follow laws about minimum wages and maximum hours. The Secretary may also take reimbursement from the plant for any overtime and holiday pay made. Money repaid to the Secretary under this rule can be spent to carry out these payments without needing another appropriation and is not limited by fiscal year.
