The Secretary must appoint a Plant Variety Protection Board made up of experts in plant variety development. The Board must include farmers and be drawn about equally from the private seed industry and from government or the public. The Secretary or a person the Secretary names will chair the Board but only votes to break ties. The Board must advise the Secretary on rules, decide appeals of examiner decisions (either as a full Board or in panels and with temporary expert members when needed), and advise on questions under section 2404. Members are not paid but may get standard government expense reimbursements.
