Title 7 › Chapter CHAPTER 57— - PLANT VARIETY PROTECTION › Subchapter SUBCHAPTER III— - PLANT VARIETY PROTECTION AND RIGHTS › Part Part L— - Remedies for Infringement of Plant Variety Protection, and Other Actions › § 2567
Owners may warn the public by putting a label on seed containers or on the variety that says either "Unauthorized Propagation Prohibited" or "Unauthorized Seed Multiplication Prohibited". After the certificate is issued, they may also add "U.S. Protected Variety". If someone receives the variety without those markings, the owner cannot get damages unless that person actually knew propagation was forbidden or that the variety was protected. Damages apply only for acts after that notice. Courts may be lenient about disposing of materials bought in good faith before notice.
