Stops people from using false or misleading labels when selling or advertising plants, tubers, or parts used to grow plants. It bans saying a plant is federally protected when it is not, saying a protection application is pending when it is not, using warnings that propagation or seed multiplication is not allowed without a good reason (that reason ends one year after the first sale unless a protection application or certificate is still active), and failing to use a required variety name. The Secretary can hold a hearing and order someone to stop, and that order is binding unless appealed under section 2461. A person convicted of breaking the order or lying to deceive the public can be fined not less than $500 and not more than $10,000. A business that is harmed or likely harmed by these acts can sue in court.
