Title 7 › Chapter CHAPTER 58— - POTATO RESEARCH AND PROMOTION › § 2623
The Secretary must hold a vote of potato producers who were producing during a representative period the Secretary sets to see if they approve a plan. If the plan would also cover importers, the Secretary must also hold the vote among importers who were importing during that same period. A plan only becomes effective if a majority of the producers voting approve it, or if importers are covered, a majority of the producers and importers voting approve it. If producers and importers do not approve a change to a plan, the existing plan is not invalidated. Ballots and any reports that would reveal how someone voted or how much they produced or imported must be kept strictly confidential. Department of Agriculture officers or employees who break this secrecy and are convicted face the penalties in section 2619(c).
