The Secretary must decide which groups can represent commercial egg producers to ask for an order and to help pick nominees. To decide, the Secretary looks at a factual report the group sends and other information the Secretary wants. The report must show where the group’s members live, how many members it has and how many are egg producers, a breakdown of egg production by State, how producers help set the group’s policies, how stable and long-lasting the group is, where the group gets its money, what the group does, and whether it can and will support the program’s goals. The main thing the Secretary will check is whether the group’s egg-producer members include a substantial number of producers who together make a substantial volume of commercial eggs. The Secretary must certify any group found eligible, and that decision is final. If more than one group is certified in the same area, they may meet together to choose the area’s nominees.
