Title 7 › Chapter CHAPTER 12— - ASSOCIATIONS OF AGRICULTURAL PRODUCTS PRODUCERS › § 292
The Secretary of Agriculture can file a complaint when he believes an association is blocking trade or keeping prices of farm products too high in interstate or foreign commerce. He must give the group a written charge and a hearing date at least 30 days later. At the hearing the Secretary will take written evidence under rules he sets. If he finds the group is unlawfully monopolizing or restraining trade and raising prices, he will order the group to stop. If the group ignores the order for 30 days or asks for court review, the Secretary files the order and records in the federal district court where the group’s main office is and notifies the Attorney General and the group. The court can confirm, change, or overturn the order, and may issue temporary or permanent injunctions. The Secretary’s findings count as initial proof, but either side can present more evidence. The Department of Justice handles enforcement. Service of papers on an officer, agent, or lawyer counts as service on the association.
