The Secretary must decide which groups can represent wheat producers, processors, end-product makers, or consumers when asking for an order under section 3403(a) or when taking part in nominations under section 3405(b). The Secretary must certify any group found eligible, and that decision is final. To decide, the Secretary will use a factual report the group provides plus other available information. The report must give relevant details such as the area and size of the membership, how many producers/processors/manufacturers it represents, how stable and permanent the group is, where its money comes from, what the group does, and whether it will support the goals of this law. For non-consumer groups the main test is that membership is mostly producers/processors/manufacturers who handle a substantial volume of wheat and that the group’s main interest is in producing or processing wheat or wheat products. For consumer groups the main tests are that the group’s purpose is consumer work (including research or education), it has a broadly representative and active membership, and it shows commitment to the chapter’s objectives.
