The Secretary must decide which organizations can represent milk producers and take part in making nominations. The Secretary must certify any organization that meets the eligibility rules the Secretary creates, and that decision is final. Certification is based on available information and a factual report the organization sends with items the Secretary asks for. The report must cover six things: the area of its active members; the size and makeup of its membership and the share of total milk producers represented; proof the group is stable and permanent; where its money comes from; what it does; and its ability and willingness to support the subchapter’s goals.
