After September 30, 1985, the Secretary must stop or pause any order (or part of it) that gets in the way of or fails to carry out the policy of this subchapter. The Secretary may hold a referendum (vote) anytime, and must hold one if a group representing at least 10 percent of affected producers and importers asks. If a majority of the producers and importers voting — who were active during a representative period set by the Secretary — favor ending or pausing the order, the Secretary must stop collecting assessments within six months and end the order in an orderly way as soon as possible. A suspended or ended order is not treated as an “order” under this subchapter.
