Title 7 › Chapter CHAPTER 80— - WATERMELON RESEARCH AND PROMOTION › § 4913
The Secretary must end or pause a plan, or any part of it, when the Secretary finds it blocks or does not help the law’s goals. The Secretary can hold a vote (a referendum) anytime and must hold one if the Board or at least 10 percent of the combined group of eligible watermelon producers, handlers, and importers asks for it. If a majority of those who vote want the plan ended or paused, and those voters account for more than 50 percent of the combined watermelon volume produced, handled, or imported by the voters, then the Secretary must end or pause the plan at the end of the marketing year.
