Title 7 › Chapter CHAPTER 87— - EXPORT PROMOTION › Subchapter SUBCHAPTER IV— - GENERAL PROVISIONS › Part Part A— - Program Controls › § 5662
Exporters and other participants in the chapter’s programs must keep all records about a program deal and allow the Secretary full access to them for up to 5 years after the deal ends. Personal information in reports can be kept confidential under section 552(b)(4) of title 5. Any Agriculture employee who knowingly reveals confidential information is subject to section 1905 of title 18. That confidentiality does not apply to information Congress asks for. If someone commits fraud or breaks program rules, the Commodity Credit Corporation can make them pay for any losses, require repayment of aid plus interest as the Secretary sets, and charge liquidated damages. After a hearing, the Corporation can suspend or debar a participant from programs for 1 or more years. False statements are covered by section 1001 of title 18.
