Defines key words used in the chapter about pecans. Board is the Pecan Marketing Board set up in section 6005(b). Commerce means trade that crosses state lines, involves other countries, or happens inside a state. Conflict of interest is when a member has a direct or indirect financial interest in a business that deals with the Board. Consumer information is information and programs to help people decide how to buy, prepare, and use pecans. Department is the Department of Agriculture. District is a U.S. area set by the Board and approved by the Secretary that produces approximately one-fourth of U.S. pecans. First handler is the first person who buys or takes pecans from a grower to market; a grower who sells directly to consumers is the first handler for their own pecans. Grower is someone who produces and sells pecans and who owns or shares ownership and the risk of loss. Grower-sheller shells pecans (or has them shelled) in the U.S. and grew 50 percent or more of the pecans they shelled in the previous year. Handle means receiving in-shell pecans by a sheller or first handler, including pecans produced by that person. Importer brings pecans into the United States for sale here. Industry information is programs to develop new markets, improve marketing, increase efficiency, and boost the pecan industry's image. In-shell pecan is a pecan with its shell still on. To market means to sell or offer pecans for sale. Member is a member of the Board. Pecan is the nut of the pecan tree carya illinoensis. Person means an individual, a group, a business, cooperative, or other entity. Plan is a plan issued under section 6003. Promotion is actions by the Board under this chapter to present pecans favorably and increase sales, including paid advertising. Research is tests, studies, or analyses to improve pecans’ image, use, markets, production, product development, or quality. Secretary is the Secretary of Agriculture. Shell means to remove the shell from an in-shell pecan. Shelled pecan is the kernel or part of a kernel after the shell is removed. Sheller shells pecans (or has them shelled) and in the previous year bought more than 50 percent of the pecans they shelled. State means any U.S. State, the District of Columbia, or the Commonwealth of Puerto Rico. United States means the States, the District of Columbia, and the Commonwealth of Puerto Rico.
