If you are subject to an order under this chapter, you can ask the Secretary to change the order or excuse you from it by filing a petition that says the order is not legal. You must be given a hearing under rules the Secretary makes. After the hearing, the Secretary will decide. That decision is final if it follows the law. If you disagree, you can sue in federal district court where you live or do business, but you must file within 20 days of the Secretary’s decision. The court uses the federal court rules for service. If the court finds the Secretary’s decision unlawful, it will send the case back with instructions to correct it or take whatever action the law requires. While these petitions are pending, the Attorney General or Secretary may still seek relief under section 6107.
