§6306 Petition and review

Title 7 › Chapter CHAPTER 92— - SOYBEAN PROMOTION, RESEARCH, AND CONSUMER INFORMATION › § 6306

Last updated Apr 6, 2026|Official source

Summary

If you are covered by an order under this law, you can file a petition with the Secretary saying the order or any duty tied to it is not legal and asking to change the order or be excused. You must be given a hearing under the Secretary’s rules. After the hearing, the Secretary will decide. That decision is final if it follows the law. You can ask a U.S. district court where you live or do business to review the Secretary’s decision if you file a complaint within 20 days after the Secretary’s ruling. Court papers must be served under the Federal Rules of Civil Procedure. If the court finds the Secretary’s ruling illegal, it will send the case back to the Secretary with directions to issue the lawful ruling or take further steps. Having a petition pending does not stop the Attorney General or the Secretary from taking actions under section 6307.
