The Secretary can create the job called Under Secretary of Agriculture for Food, Nutrition, and Consumer Services. If the job is created, the President must pick the person and the Senate must approve them. The Secretary must give that Under Secretary the Department’s food, nutrition, and and consumer-services work (except as another law, section 6981(b)(1), says). The Under Secretary must also do other tasks required by law or assigned by the Secretary. A person who was serving as Assistant Secretary of Agriculture for Food and Consumer Services on October 13, 1994, and who was appointed by the President and approved by the Senate, does not have to be reappointed to the new Under Secretary job if the Secretary creates the position and puts that person in it within 180 days after October 13, 1994 (or a later date the Secretary sets if litigation delays the change).
