§7000 Implementation of final determinations of Division

Summary

When a case is sent back to an agency after a final decision by the Division, the agency head must put that decision into effect within 30 days after the decision's effective date. Within 180 days after this subsection is enacted, and every 180 days after that, each agency head must send a report to the House Committee on Agriculture and the Senate Committee on Agriculture, Nutrition, and Forestry and post it on the Department's website. The report must list all cases returned under Division final decisions in the period, say whether each decision has been carried out, and, for any not carried out, explain why and give a planned date for doing so. Each month the agency head must post any updates to those reports on the Department's website.

(a)On the return of a case to an agency pursuant to the final determination of the Division, the head of the agency shall implement the final determination not later than 30 days after the effective date of the notice of the final determination.
(b)(1)Not later than 180 days after the date of the enactment of this subsection, and every 180 days thereafter, the head of each agency shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate, and publish on the website of the Department, a report that includes—
(A)a description of all cases returned to the agency during the period covered by the report pursuant to a final determination of the Division;
(B)the status of implementation of each final determination; and
(C)if the final determination has not been implemented—
(i)the reason that the final determination has not been implemented; and
(ii)the projected date of implementation of the final determination.
(2)Each month, the head of each agency shall publish on the website of the Department any updates to the reports submitted under paragraph (1).
