Allows the Secretary of Agriculture to create an Under Secretary of Agriculture for Marketing and Regulatory Programs. If created, the President must pick the Under Secretary and the Senate must approve that pick. When set up, the Secretary must give the Under Secretary duties tied to agricultural marketing, animal and plant health inspection, grain inspection, and packers and stockyards. The Under Secretary also must carry out other duties required by law or given by the Secretary. An Assistant Secretary holding that job on October 21, 1998, who was appointed by the President with Senate approval, does not need a new appointment if the Secretary makes the new post and the person steps into it within 180 days after October 21, 1998 (or later if the Secretary allows due to litigation delays).
