§7487 Enforcement

Summary

The Secretary can issue an order to stop someone from breaking rules under these regulations and can fine them up to $1,000 for each violation. A fine can only be imposed after the person is given a chance for an administrative hearing and the Secretary decides this process is suitable for enforcement. Federal district courts can enforce these orders and stop people from violating them. Any civil case brought under these rules must be sent to the Attorney General for action.

(a)The Secretary may issue an enforcement order to restrain or prevent any person from violating an order or regulation issued under this subchapter and may assess a civil penalty of not more than $1,000 for each violation of the enforcement order, after an opportunity for an administrative hearing, if the Secretary determines that the administration and enforcement of the order and this subchapter would be adequately served by such a procedure.
(b)The district courts of the United States are vested with jurisdiction specifically to enforce, and to prevent and restrain any person from violating, an order or regulation issued under this subchapter.
(c)A civil action authorized to be brought under this section shall be referred to the Attorney General for appropriate action.
