Summary

When the Agricultural Research Service charges fees for accepting or sending out microorganisms for its Patent Culture Collection, that money must go into the same fund that pays to run and maintain the collection. The Service can use those funds right away, without needing extra approval or being limited to one fiscal year, to meet its legal duties (including any international treaty obligations) for the Patent Culture Collection.

Title 7, §7641

(1)All funds collected by the Agricultural Research Service of the Department of Agriculture in connection with the acceptance of microorganisms for deposit in, or the distribution of microorganisms from, the Patent Culture Collection maintained and operated by the Agricultural Research Service shall be credited to the appropriation supporting the maintenance and operation of the Patent Culture Collection.
(2)The collected funds shall be available to the Agricultural Research Service, without further appropriation or fiscal-year limitation, to carry out its responsibilities under law (including international treaties) with respect to the Patent Culture Collection.
