When state, local, or tribal authorities ask, the Secretary must decide whether to approve methyl bromide uses they require to stop plant pests (including diseases) or noxious weeds. Approval is allowed only if no registered, effective, economically feasible alternative exists. The Secretary must help find alternatives and start research when none exist. A registry must be published not later than 180 days after May 13, 2002 and kept; once rules exist, requests must be decided within 90 days. Nothing here changes the EPA Administrator’s Clean Air Act authority.
