The Secretary must offer nonrecourse marketing assistance loans to farmers for crops harvested in 2002 through 2007. Farmers can get these loans for any amount of a loan commodity grown on their farm. The loans follow the Secretary’s rules and use the loan rate set by law. If a farmer’s crop got mixed with others in storage that is not licensed, the Secretary still must make the loan if the farmer agrees to immediately redeem the loan collateral as required by section 166 of the Federal Agriculture Improvement and Reform Act of 1996 (7 U.S.C. 7286). Farmers must follow the conservation and wetland protection rules under the Food Security Act of 1985 (title XII, subtitles B and C) while the loan is in effect. However, no nonrecourse marketing assistance loans are allowed for the 2002 crop under subtitle C of title I of the 1996 Act.
