Gives the Secretary of Agriculture the power to fix problems for people in certain farm programs who become ineligible for loans, payments, or other benefits because they did not meet program rules. Relief can be given if the person, acting in good faith, relied on the Secretary’s action or advice and was hurt by it, or if the person made a good faith effort but still failed to meet the rules. Covered programs are those run by the Secretary that give price or income support, production or market loss help, or conservation payments. It does not cover farm credit programs under the Consolidated Farm and Rural Development Act or crop insurance under the Federal Crop Insurance Act. Quick definitions: "agricultural commodity" means farm products covered by these programs; "participant" means someone in a covered program; "State Conservationist" and "State Director" are the state officials who run the Natural Resources Conservation Service and Farm Service Agency programs. Relief can let a person keep or keep getting loans, payments, or other benefits; stay in a contract; re-enroll land in a conservation program; or get other fair remedies. The Secretary can require the person to correct the problem. State Directors and State Conservationists may grant smaller amounts of relief themselves if the new relief is under $20,000, prior relief to that person was no more than $5,000, and total relief to similar people is not more than $1,000,000. Their decision must be approved by the Department of Agriculture’s Office of General Counsel and can only be reversed by the Secretary. These discretionary decisions are final and not reviewable under chapter 7 of title 5. By February 1 each year, the Secretary must report to the House and Senate Agriculture Committees the number and outcome of relief requests under these rules and under section 6998(d). The authority here is in addition to any other legal authority.
