The Secretary may make fee agreements to do preclearance of animals or other items at locations outside the United States before they move into the United States. Fees for those preclearance activities can be collected in advance. The money must be added as offsetting collections to the current appropriation, account, or fund of U.S. Customs and Border Protection, stay available until spent, be used only for the same purposes allowed by that account, and may be collected or used only if Congress allows it in appropriation laws. The Secretary may pay Department of Agriculture officers or employees extra for overtime, night, or holiday work at a rate the Secretary sets, and may require the person receiving the service to repay those expenses. Repayments, and any late payment penalties or interest charged under section 3717 of title 31 if someone fails to pay, must be credited to the account that covered the costs and remain available until spent, without a fiscal year limit.
