Approved use of MAGNASTOR® under general license

If your nuclear power plant holds a general license under 10 CFR part 72, you may load spent nuclear fuel into NAC International MAGNASTOR® casks that meet the revised Certificate of Compliance Nos. 0 through 13 and new Amendment No. 14. The rule becomes effective March 19, 2025.

Six-month implementation and written checks

General licensees using the revised Certificate of Compliance must implement the revised certificates within 6 months and perform written evaluations in accordance with 10 CFR 72.212(b)(5) to show casks conform to the revised terms. The 6-month timeframe is described as a standard implementation period.

Amendment 14 applies only to new casks

Amendment No. 14 applies only to new MAGNASTOR® casks fabricated and used under Amendment No. 14; existing users continue to be covered by Amendment No. 13 and are not required to adopt Amendment No. 14 but may do so voluntarily. This distinction is stated in the rule text.

No significant environmental or dose changes

The NRC determined that implementing Amendment No. 14 and revisions to Amendments 0 through 13 will not significantly change effluent releases, occupational or offsite radiation doses, or the potential for radiological accidents. The finding of no significant impact supports that an environmental impact statement is not required.

No significant impact on small entities

The NRC certifies under the Regulatory Flexibility Act that this direct final rule will not have a significant economic impact on a substantial number of small entities; the rule affects only nuclear power plant licensees and NAC International, Inc. and those entities are not small under NRC size standards.
