Clearer Suspension and Debarment Rules

If you are a contractor or small business, the FAR was changed to make suspension and debarment procedures more consistent with nonprocurement rules and to increase transparency. These changes take effect January 17, 2025, and are expected to have a positive impact on small businesses though they are not expected to cause significant economic impact for a substantial number of small entities.

Rerepresentation Required for Multiple-Award Orders

If you are a small business that claimed a small-business size or socioeconomic status on a multiple-award contract, you must rerepresent your size and/or socioeconomic status for certain orders. This applies to orders set aside under unrestricted multiple-award contracts (unless the order is issued against a reserve that already required size/status) and to orders under multiple-award contracts that were set aside when the order requires a different socioeconomic status; Federal Supply Schedules are exempt. These changes take effect January 17, 2025.

Incentives for Puerto Rico and Territory Small Businesses

The FAR was amended to implement SBA changes that add incentives for certain U.S. territories under the SBA mentor-protégé program (implementing section 861 of Public Law 115-232 and section 866 of Public Law 116-283). The rule also specifies which entities are not required to submit subcontracting plans as subcontractors. These changes take effect January 17, 2025, and will impact small businesses with principal offices in the Commonwealth of Puerto Rico or covered territory businesses that enter SBA-approved mentor-protégé agreements.
