Erythritol From the People's Republic of China: Initiation of Countervailing Duty Investigation

Published Date: 1/10/2025

Notice

Summary

The U.S. Department of Commerce is starting an investigation into whether China is unfairly helping its erythritol producers with subsidies. This could lead to extra taxes on erythritol imports from China to protect U.S. makers like Cargill. The investigation kicked off on January 2, 2025, and could impact prices and trade soon.

Analyzed Economic Effects

3 provisions identified: 1 benefits, 1 costs, 1 mixed.

CVD Investigation Started for Erythritol

The Department of Commerce initiated a countervailing duty (CVD) investigation into erythritol imports from the People's Republic of China, applicable January 2, 2025. The investigation covers the period January 1, 2023 through December 31, 2023, and Commerce will make a preliminary determination no later than 65 days after initiation.

Company-Specific Subsidy Rates to Be Calculated

Commerce intends to calculate company-specific subsidy rates and may select mandatory respondents from the 83 companies in China identified in the petition. Commerce released U.S. Customs and Border Protection (CBP) import data for respondent selection and will use that data if it cannot individually examine all companies.

Domestic Industry Petitioned — Cargill Lead Petitioner

The petition requesting CVD and antidumping measures was filed on December 13, 2024 by Cargill, Incorporated on behalf of the domestic erythritol industry, and the petitioner stated there are no other known U.S. producers so the petition is supported by 100 percent of the U.S. industry. Commerce found that the petitioner demonstrated sufficient industry support for initiation.
