100,000 Short-Ton Exemption Rule
Manufacturers that make less than 100,000 short tons of paper and paper-based packaging in a marketing year are exempt from paying assessments. Exemptions are annual (you must reapply each year), you may apply at any time during the marketing year, the Board counts combined quantity toward the 100,000 short-ton threshold, and importers deemed exempt will have refunds issued no later than 60 calendar days after the Board receives such assessments.
Importers Pay Board Directly
Importers must pay assessments directly to the Paper and Packaging Board instead of through U.S. Customs, and each importer must pay the assessment within 30 calendar days after the end of the quarter in which the goods were imported. Customs will no longer collect these assessments for the Board.
Partnership Definition Clarified
The Order adds a definition for 'partnership' that explicitly includes spouses with title or leasehold interests and 'joint ventures' where parties contribute land, facilities, capital, labor, management, equipment or services. This clarifies which partnerships are responsible for paying assessments and transferring title to manufactured or imported paper and paper-based packaging.
Electronic Voting Allowed for Board
The Board and committees may conduct meetings and voting by electronic means or other communication methods so long as votes are verifiable, a quorum is met, and votes are recorded. The Board may also take action by non-assembled vote if notified and given the opportunity to vote.
