Countervailing Duties Added to Vietnam Plates
The Department of Commerce found countervailable subsidies for certain paper plates from Vietnam and extra taxes (countervailing duties) will be applied starting January 28, 2025. The notice says this action helps U.S. businesses compete fairly and affects importers and exporters who deal with these paper plates.
Specific Duty Rates Set for Named Firms
Commerce calculated estimated countervailable subsidy rates for the period January 1, 2023 through December 31, 2023 and found: Go-Pak Paper Products Vietnam Co., Ltd. and 'All Others' at 5.53 percent ad valorem, while Xie Li and four non-responsive companies (Innovative Sonic Vietnam International; Ningbo Changya Plastic Vietnam Company; Ningbo Changya Plastic Vietnam; SCG Vietnam) have rates of 225.90 percent ad valorem (rate based on adverse facts available).
Retroactive Suspension of Liquidation Periods
Commerce instructed U.S. Customs and Border Protection to suspend liquidation of entries of subject paper plates: for Go-Pak for entries on or after July 1, 2024, and for Xie Li, the four non-responsive companies, and all other producers/exporters for entries on or after April 2, 2024. Commerce directed CBP to discontinue suspension for entries entered on or after October 29, 2024, but to continue suspension for entries between April 2, 2024 and October 28, 2024.
Possible Cash Deposits If ITC Finds Injury
If the U.S. International Trade Commission issues a final affirmative injury determination (to be made no later than 45 days after Commerce's final determination), Commerce will issue a countervailing duty order, reinstate suspension of liquidation, and require a cash deposit of estimated countervailing duties for affected entries.
