EPA extends electric arc furnace pollution data collection—no big changes

Published Date: 2/28/2025

Notice

Summary

The EPA is asking to keep collecting info from electric arc furnace steelmaking facilities to make sure they follow pollution rules. This renewal won’t change the rules but keeps the paperwork going through February 28, 2025, with a chance to comment until March 31, 2025. Steelmakers and the public should note this keeps the process smooth without new costs or big changes.

Analyzed Economic Effects

3 provisions identified: 0 benefits, 2 costs, 1 mixed.

Renewal keeps reporting rules in place

If you operate an Electric Arc Furnace (EAF) steelmaking facility, the EPA is renewing its information collection that requires you to submit notifications, performance tests, periodic reports, and keep records under 40 CFR part 63, subpart YYYYY. The renewal keeps the paperwork and semiannual reporting requirements in force through February 28, 2025, and the public may comment until March 31, 2025.

Estimated annual compliance burden and cost

The EPA estimates the renewal covers about 80 EAF steelmaking respondents and will result in a total respondent burden of 3,920 hours per year and total respondent costs of $548,000 per year (which includes $10,700 in annualized capital or O&M costs).

Updated estimate changes: burden down, labor-costs up

The ICR reports a decrease of 80 hours in total estimated respondent burden compared with the prior approval, an increase in cost estimates due to use of updated Bureau of Labor Statistics labor rates, and an overall decrease in Capital/O&M costs after adjusting 2021 dollars to 2023 dollars and revising the expected number of new respondents.
